COLUMBUS - A new office in
the executive branch of stale
government has been created to
help assist Ohio's veterans with
their problems.
The Governor's Office of Veterans Affairs has been established to
.advise the governor on veteran
related matters and to coordinate
veteran matters with county veteran service officers, soldiers' relief
cornmlsslons and with the Veterans
Administration. It will also coordinate with the Ohio Bureau of
Employment Services on job trainIng and related matters. The office
will be an expeqsion on .t he existing
capabilities of the Division of
Veterans Affairs located In the

procedures were not followed In assigning the case.
Mascio's nullified order also refused to grant a

behalf were his parents, Aaron and

under oath they willing to sign for a
bond to release Hysell from jail and

sheriff's department spokPSman,
Hysell was released from the Meigs
County Jail about 12 noon Wednes·
day. Hysell had been In custody in
Meigs County since authorities
arrested him July 16.

Following the hearing, the judge
said his decision to set the low bond
was based on Hysell 's past service
record.
A discovery date for submission of
Information related to the case was.
set by the judge for Sept. 6. A trial
date was set for Dec. 9.

:Wired for hazard
The observation that "justice del ayed Is justice denied" dates back to
19th century Victorian England, but It's applicable to a "'!"temporary legal
.
dispute in this country.
For almost a decade, thefedeal courts have sought-with only limited
success - to detetmine whether aluminum wiring used in the electrical
i:trcuits of homes and other buildings poses a serious Ure hazard.
·
Copper traditionally has been used for that purpose, but supply
'shortages and price inct·easesaffecting that metal during the late 1960s and
early 1970s induced electrical contractors to turn to aluminum as a
substitute. Some two million homes were wired with aluminum between
1965 and 1973.
Although long used for hi gh-tension utility wires, a luminum' s physical
:Properties can lead to the generation of Intense heat- and sometimes lire
- unless the wire is installed with great care and connected to specially
l!esigned terminals. After 1973 the industry devised a new and safer system
for aluminum wiring.
After testing electrica l clrcufis In hundreds of homes in four staes, one
independent research organization concluded that "the risk of an
aluminum wired home having at least one (electrical) receptacle reaching
fire hazard condition was 55 times that for a copper-wired home."
After a four-year Investigation, the Consumer Product Safety
:Commission In 1977 filed a civil suit suit in federal court against more than
~two dozen manufacturers of aluminum wire an~ associated components.
That lawsuit sought to have aluminum wiring systems declared
"Imminently hazardous consumer products" on the grounds that. they
exposed the public to " imminent and unreasonable rls~ of fire leading to

death or severe personal injury."
But one year earlier, the Kaiser Aluminum &amp; Chemical Corp., the
:nation's largest producer of aluminum wiring, had filed a civil suit against
the CPSC in federal court in Wilmington, Dei., alleging that the
commission had disseminated ''incomplete, inaccUrate, unfair and
r)lisleading Information'' about the company's product.
After years of lltlga lion in trial courts, then in federa l appeals courts In
Philadelphia and here in Washington, the Issue was finally resolved in 1982
with a judicia l ruling that the CPSC lacked jurisdiction to regulate
household aluminum wiring systems because they technically were not a
"consumer product."
In 1977, however, an event occurred that overshadowed all of the legal
wrangling; A fire In the crowded Beverly Hills Supper Club In Newport,
Ky. killed 165 people unable to escape the rapidly spreading blaze.
The suspected cause was pre-1973 aluminum wiring. but again that
theory had to withstand a court challenge. More than a dozen electrical
_manufacturers were named as defendants In a civil suit flied by the
"victims' survivors.

A federal court jury concl~ded in 1980 that aluminum wiring was
blameless for. the disaster- but that ruling was overturned by the federal
appea ls court in Cincinnati on the grounds tha t one of the jurors acted
Improperly.
A new trial was ordered and in mid-July of this year a jury in U.S.
: District Court in Ashland, Ky., held that aluminum wiring was indeed the
· ptincipal cause of the fire . By then, however, all but one of the defendants
: had reached out-of-court settlements. Ka iser. for example, settled for $1.2
· million. Underwriters Labora tori es. the industry's research organization
whose testing supposedly ensures the safety of electrical products. paid
$8.'i0. !XX!.
Today- eight years after the night-club fire. nine years a fter the first
. lawsuit was filed and 12 years after the CPSC launched its Investigation; the victims '. families have received a small measure of symbolic justice.

WASHINGTON -The Pentagon
has quietly asserted control over
millions of acres offederalland in a
move that puts the.Defense Department squarely at odds with Big Oil
and on the side ot'
environmenta lists. ·
The strange "lang grab" involves
huge portions of the Outer Continental Shelf that the Interior Department wants to lease to the oil and
gas industry for offshore drilling.
The Pentagon has designated 115
million acres of the underwater
"land" off-limits to exploitation. By
comparison, the total amount of
wilderness protected from development In Alaska . and the lower 48
states is only 89 million acres.
The Pentagon claims that preservation of the offshore areas is vital
to submarine and other operations
required for national defense. The
appearance of oil rigs and exploration equipment would make these
military operations difficult if not
impossible, the Pentagon says.

bureaucratic battle:
The ocean-bottom land has been
a subject of controversy ever since
then-Secretary of Interior James
Watt proposed leasing nearly a
billion acre• for oil and gas

development four years ago.-Partly
on environmental grounds, Congress Imposed a moratorium on·
some of the leases, covering about
45 mllllon acres.
The Pentagon's secret war with
the Interior Department has been
going on ever since. "Disagree·
ments between the agencies were
well hidden," wrote an expert tn the
congressional Office of Technology
Assessment. "However, what was
once handled on a routine case-bycase hasis seems now to be turning
Into a problem too broad and
complex to be dealt with ad hoe."
Complicating the matter Is tbe
lack of clear authority over withdrawal of public lands for military
purposes. One law gives this lXIWer
to the president and the defense
secretary; another gives It to
Congress. Playing it safe, the
Pentagon refers to Its assertion of
authority over the offsbore land ·
merely as "deferrals" of
development.
In testimony last year before a
House subcommittee, one defense
official said the Pentagon supported tt.e congressional ban for
national security reasons. Several
weeks later, the same official told
another subcommittee the Defense
Department opposed the morato-

While the NAACP was supportIng CBS in Its battle against a
hostile takeover by Atlanta entrepreneur Ted Turner. CBS was
stabbing its ally in the back.
The NAACP's argument In CBS'
favor said that Turner. the celebrated "mouth of the South," didn't
have CBS' sensitivity on racial
matters. But CBS' recent action
makes Turner seem like a dedicated freedom fighter and the
network an apologist for the worst
kind of racial stereotypes.
First, some history.
Thirty-four years ago, In late
June 1951, the NAACP held a
national convention In Atlanta. One
of the most urgent concerns was
television, a subject now for both
the NAACP and the nation.
·
The NAACP, then as now the
largest national voluntary association of black people fighting for civil
rights. had decided to respond to an
attack this new medium had
leveled on black America. It was
the airing of a show on CBS that was
being transferred to tbe new
medium from radio, a sbow which
broke ground · In television only
because It had an all-black cast.
For those of you too young to have
seen tbat series, "called "Amos 'n
Andy, " here's what you missed: a
show written, directed and produced by white men. featuring
' black men who never had or sought
a job - a vicious stereotype most
Americans hoped had vanished
with the minstrel shows.
As the NAACP sald in a 1951
lawsuit against CBS, the show
"strengthens the conclusion among
unlnlormed and prejudiced people
that Negroes are lnlerior, lazy,
dumb and dishonest. Every character In his one and only show with an
ail-Negro cast is either a clown or a
crook. Negro doctors are shown as
quacks and thieves . Negro lawyers

are shown as slippery cowards,
Ignorant of their profession and
without ethics. Negro women are
shown as c aclding, screaming
shrews In big-mouth close-ups
using street slang just short of
vulgarity."
The show had been a favorite of
Americans on radio since the early
1930s. Its main characters, portrayed on radio by· Freeman
Gosden and Charles Otrrell, two
white actors, were described by
media hlstorlal J. Fred McDonald
as "classical minstrel figures."
Amos Jones (eventually played by
Alvin Childress) was a low-key,
compliant Uncle Tom. He and his
wife, Ruby, were an unhumorous
two-some who tried to bring reason
and levelheadedness ·to bear upon
their rascally Harlem friends.
Andy, whose full name was
Andrew Hogg Brown (played by
Spencer Williams Jr.). was an
easygoing dimwit who always had
an eye for a pretty girl and never
ceased to be duped by his supposed
friend. In George "Kingtlsh" Stevens (portrayed by T!ln Moore), the
show presented the sterro-typical

was not until 194j6 that CBS agreed
to wltltdraw the sbow.
Now .the president of the CBS
Broadcasting Group, Gene Jankowski. has begun to test public
sentiment on reviving this scandalous'outrage and on allowing It to be
seen on American television once
again. He 'asked an Atlanta TV
critic. · John Carman, to write a
· column inviting audience comment
on bringing back "Amos 'n Andy .''
The comment - most of it from

white Atlantans- was overwhelmIngly favorable, but now CBS needs
to be&lt;ir from those who think this
slap In the face ought to remain out
of public view.
One of CBS' arguments against
the Turner takeover attempt Is that
the Atlanta-based tycoon is a
hopeless bore, and that his "superstation," Channel 17, lowers the
level of taste on television.
CBS is making Ted Turner look
like a class act.

She was retired after 25 years at

asked a federal bankruptcy judge to
order Wheellng-Piltsburgh Steel
Corp. to provide $1.8 million to pay
for 30 days of health Insurance
coverage for striking and laid-off
