Voice of Broadway ••. reporting
ly DORO'THY KILGALLIN

All the sweating that Is bein& done In
the . apple green courhoom with the lazy
apple ~reen ceiling fans is being done
ov.t r h1m.
. The lone crowded row of brilliant,
permaslve, charming deceptive tough
and reallltic lawyers Is split down t h e
middle over Jack Ruby's fate.
. The judge takes off his glasses a n d
mllpl his brow with a powder blue hand·
kerchief after a difficult legal decision.
Tbe Ion& wooden church pews are filled
with hot and restless reporters straining
to -eatch every word from a prospective
jtU'Or that might affect Jack Ruby, fa·
vorably or adversely.
fbe tottldora or the courthouse a•·e
elcilled with guards, television cameras,
doJluUes, newspaper photographers, sh,.
rlfla•. balliffa, foreign correspondents. Vi·
siUne lawyers, judges from other floors,
well-dressed soft-voiced ladies who have·
n't enou&h pull to get Into the courtroom but are content to sit on benches
or lean on wall• outaide and watch the
action.
The action revolves around Rub!·· Ru·
by the strip club owner. Ruby, the natty,
runty booz,.seller who scared the unfortunate airl dancers who peeled for his
cllltomero but could be charming and
jovial when • cop came Into his place.
His own lawyen - a formidable bat·
lety headed by Melvin Belli, a genius
In •11¥ courtroom - have documented
more than 100 Incidences In which he
demonstrated erratic and fri&htenin& be·
Footnote for Historians
DALLAS - The Carl Sandburgs of
the future will spend whole lifetimes try·
lng Ill analyze the drama of this week
and thla scene.
They will never be able to appreciate
tbt unparalleled Irony that exists today
in this proud and eraclous city.
What it all boils down to - after the
uaanlllatlon or a President, the wound·
inl of 1 governor the slaylq of a policeman and the k(lllnl of a man nobody
really lu!ew - · is little Jack Ruby.
The hustler In the black suit and the
very white ahirt, neal and nervous, Is
the lllr of a show at last. If he died tomorrow - and he won't - he would die
happy in the knowledge that he had
madt the bll time. . .

havlor long before Nov. 24. 1963, I he
day on which he strode pasl television
cameras to kill Lee Harvey Oswald and
give birth to more confusion and shame
and mystery than any other man has ev·
er before created with a single bullet.

•

•

•

•

•

•

Perhaps Jack Ruby's brain is damag·
ed, as his defense claims. Perhaps he
killed Oswald during a period of "epi·
sadie disfunction," as his lawyers will
tell the eventual, inevitable jury. Per·
haps all killers are in "a rage state selz.
ure" another predictable defense
term - when they pun the trigger or
stab the heart.
But in court, Ruby is functioning pre!·
ty well. He is "zingy" - a Texas term
for jittery - and Inclined to worry over
small problema far removed from the
main peril, which is the death penalty.
W)len his sister visits him In jail, he
exercises extreme caution, writing out
messages to her and receiving her an·
swers In writing, for fear of being over·
heard; or speaking to her in Yiddish,
which his guards do not understand.
In an impassioned moment, lawyer
Belli described his client as "tensing
up very much." He said he didn't kno'l'
how lone Ruby ceuld stand the strain
or a trial, or the waltin&, the bein& cag·
ed, let alone the hours he faces on the
witness 1tand.
Yet little more than an hour later the
defendant bounced quietly back into the
courtroom, lightly, lik• a dancer under
clumsy guard.
I was atandlnc by the bar railln& a•
he turned to take his seat and he broke
into a quick amlle, gave me a friendly,
bird-like nod, and said "hello." Brightly.
Then everything quieted down and as
Judge Joe B. Brown returned to t h e
bench Jack Ruby became just a head
In the crowd up front - a bald pate sha·
dowed by a few pen-strokes of black
hair.
It was sickening to think that the trial
waa taking plate because of a visit to
Dallaa by a tall and brilliant and graceful younc man named John Fitzgerald
Kennedy. And now John Kennedy is
dead, and all !bat is left to Dallas and
to history is Jack Ruby.
