2 Nations Salute Philippines Hero

lJnaglne that Prance, after aiding the
Americans to drive out the British in
1781, bad concluded peace with E111·
Ianj! and prepared to take over the colonies herself.
I!n•line that George Washington had
been proclaimed the first president of
a republic, had launched a second war
for mdependence and, after two years
of bitter struggle, bad been captured by
the French tbrou&b a clever trick.
Imagine that Wuhlngton then, for the
JOOd of bb country and witb the hope
of eventually seelnl It win its freedom,
bad pled1ed allel!ance to France. And
imii!De !bat he had lived another 45
yean to see tbe dream come true.
The parallel Is an exaggeration, but
It lives an idea of tbe veneration in
whfeh the late Gen. Emlllo Aguinaldo is
beld by the people of the Philippines,
whll mourn his recent death.
It was In 1896 that the youthful Agui·
naldo be&an his long struggle for the
freedom of his country - first against
the Spanish, who had ruled the Philippines since 1565.
Exiled in 1897, Aguinaldo came back
to the Philippines at the request of Ad·
mira! Dewey after the defe•t of t h e
Snanisb fleet. He Ol'j!ani2ed a new anny
and had control of the main island of
Luzon by the time the Spanish-American war ended.
He was not permitted to enter Manila.
which had been captured by the Ameri-

:

cans. There then began 1 fu more coatly
war between the erstwhile allies.
Aguinaldo had been led to believe that
tbe Philippines would be liven indepen·
dence. When, in~teacl, the Unltld states
annexed them, he took up urns 1~
as president, at 30, of the first Phillppines Republic.
It was a bloody war, and the small,
wiry " bandit Aguinaldo" became a
houoehold name In America. Ho was tbe
epitome of the crafty, elusive guerilla,
nemeois of an army of 120,000 American
soldiers.
When it all ended in 1901 with Agui·
naldo's capture and pledge of peace, it
had cost the U.S. a third of a billion dol·
Iars and the Philippines 116,000 lives.
Aguinaldo kept his parole. He retired
into virtual seclusion, except for a try
at the Philippines presidency in 1936.
The Japanese tried to use him 11 a Qui•
ling in 1942. The Russians were to claim
as late as 1952 that the Americans bad
murdered him.
He lived another 18 years after the
Philippines at Jast became independent
in 1946, watching the fledgling nation
grow in strength and wisdom.
The United States and the Philippines
have learned much from each other. To·
day, the two countries and two peoples
are united in saluting the memory of
Emilio A~u!naldo , who would have been
95 in March.

Voice of Broadwav •.. reporting
ly DOROTHY KILGALLEN

DALLAS: The day In, day out, hourby-hour and minute-Dy-minute question
in tbe courtroom of Jack Ruby's tnal for
murder is: Can the defendant get a fair
trial in Dallas? ·
An integral part of the question is an·
other question: Can they even get a jury
here'
The prosecution hopes so. The de·
tense hope< not. The judge won't go on
the record with a Jlredlc.tion but it i~ not
hard to mterpret hts rulmgs. He believes
he fill get a jury and try the case right mhis!Owtj bailiwick-and in the not too distan! future .
·
read bls honor's mind conectlv.
I a
with him. Jack Ruby, wilh his
Ja . er's streak. must know that mat hemaltcally the odds almost guaranteed a
Dall~s jury unless Jud~e Brown him<elf
decl~ed on a change of venue, and since
he has rone this far it is obvious he has
no intention of sending this historical
tnal to El Paso.
.State and defense combined had only
30 peremptory challenges when the first
prospective .iuror took the witne'" <land
to be examined 011 his qualific? ·ions.
Subtract this from 200 veniremen ready
and waiting in the courthouse and you
hava 170 left.
Subtract any number of challen~es
for cause-the juror could not vote for
npltal punishment, or the juror could
not "lay aside" a "fixed idea" as to the
JUiit or Innocence of the accused - and
subtract for a few prospects who cannot
aervo for reasons of health or personal
matters, you still wind up with 12 Dallas·
Jtes in the box unless a bomb drops on
the courthouse.
•
•
After observing the troJJ and its princlpala for a few days, and meeting many
people In Dallas, I will go out on a limb
with this "Winter hook" guess:
They will get a jury in Judge Brown's
aecond noor courtroom. The jury will be
dil rnt, alert and conscientious. When
the verdict is rendered Jack Ruby will be
convicted of something, but the death
penalty will not be voted.
He will not go scot-free, but be wUI
not d,ie in the electric chair.
Tbe defense .attorneys have been
contending vigorously that It Is Jrnpossi·

,_,•n

Do It

Time

ble for the defendant In this case to get
a fair trial in Dallas, because any citizen
with an ounce of pride in his native city
would be consciously or unconsciously
embarrassed and affected by the cribclsm that has been leveled at Dallas
from all parts of the world since tlie assassination of Prellident Kennedy and the
fantastic chain of events that followed.
The lawyers for Ruby have hammered at !h~ citizens' self-com~lo~w~~ qv~r;
"the tmage of Dallas," and in this facet
"' thel.-oease th.. are quite correct.
•
•
•
....
The people of Dallas are particularly
proud of !heir Image and they want to be
recogn!r.ed for what they ar~r for
what the majority of them are-rather
than suffer indiscriminate mass humllia·
lion at the hands of editorial writers, "In
depth" magazine researchers and for·
eigners performing amazing feats of
lon~-distance conclusion jumplllf.
But I don't believe the emotions of
the people who live where the great trag·
edy happened will send Jack Ruby to the
electric chair. no matter how hard D. A.
Wade fights for the severest penalty.
And I doubt if the most magnetic
blandishments of the defense team will
send Jack Ruby walking out into the
Dallas sunshine a free mAn-free to
make a personal appearance tour or
write his memoirs or open a new striptease club or las chief counsel Melvm
Belli would recommend) check into a
hospital for psychiatric treatment.
I have, before this, observed commu·
nities pressured by the onus of a crime,
bringing in the spotlight of publicity tbey
never asked for. Usually, and aometlmes
quite apart from tbe eYldence in the
case, the jurors in such an uncomfort..
able community take the middle road.
They want to be fair, they don't want
to spend sleepless nights wondering If
the man lbey sent to his death . might
have been innocent by way of o reason·
able doubt-but they are human, they
have husband& or wives or bossea or
friends with strong opinions, and they
don't want to spend the rest .of their
lives explaining why they l~t tbabo-1,nd·
ao go free.
And so, very often in a case like this,
compromise becomes justice,
