School Prayer Decis~on

"A Penny for Your na..ghts"

The Daily Sentinel
It is wholly natural and llbderstand·
able that the response too so. profoun~ a
ruling as the Supreme Court's decl&ion
in the school prayer cases should reflect
dl'Op divisions within the country.
Many legal scholars say that tl)e high
court's prime !unction is to try to settle
the great, devislv~ issues that otherwise
might tear our society apart. The court
dotS not creal• these diviSions It simply
attempts to d•al with them when they
appear.
On its face, the relation between
church and government is now and al·
wavs has been a potentially disruptive
question. Human feelings on the subject of religion are strong No tess strong
are the words of the U.S. Cnnstitution
aeclaring that church and stat• shall he
kept separate, and religious freedom
shall be assured to all persons.
In the current controversy, complaint
comes from citizens who sav that freedom has been abridged by state or city
laws which require the readmg of the
Biole and the Lord's Prayer by school
pupils.
One of. the complainants has no rell·
gion, the other is a Unitarian and does
not accept all parts of the Bible
The Supreme Court's decision I h at
such religious practices do violate the
Constitution has the endorsement of
many, though far from all, religious organizatioons and leaders.
It should be noted also that the U.S.
rourt is not a pioneer in this field Sev-

government.

'
A slrlkiq diasent comes from Dean

Erwin N. Griswold of the Harvard Law
School AntictpatiJII the court's latest
ruling, and commenting on its 1982 derision In the celebrated New York case,
he says the court II construing the Con·
stimtion's language in far too rilid "absolutist" terms.
·
He argues that the founding fathers
meant to bar establishment of a stelesupported church, but not to expunge
from the nation's Ufe all sigilli and ceremonies of rellgloua nature.
Griswold contends further that anyone
who objects to school prayen, Bible
reading or other such practices can preterve his freedom simply by d~~Ciinlng
to tak• part. He says the penon who
does this must accept minority status
this places him in - and yet has a right
to expect the tolerance of othen.
The high court says In reply that even
when a law excuses those who do not
wiJh to participate, It is still coercive and
puts a stigma on the objectors.
In the cases just decided, it II o!so a
fact that tolerance by the majority wu
sadly breached. The complainant in Baltimore has seen her son abused physical·
ly many times, her home and car often
attacked, herself refused work. The Unl·
\arian in Pennsylvania has been subject
to violent, sometimes obscene written

abuse.

School Prayer Decis~on

"A Penny for Your na..ghts"

The Daily Sentinel
It is wholly natural and llbderstand·
able that the response too so. profoun~ a
ruling as the Supreme Court's decl&ion
in the school prayer cases should reflect
dl'Op divisions within the country.
Many legal scholars say that tl)e high
court's prime !unction is to try to settle
the great, devislv~ issues that otherwise
might tear our society apart. The court
dotS not creal• these diviSions It simply
attempts to d•al with them when they
appear.
On its face, the relation between
church and government is now and al·
wavs has been a potentially disruptive
question. Human feelings on the subject of religion are strong No tess strong
are the words of the U.S. Cnnstitution
aeclaring that church and stat• shall he
kept separate, and religious freedom
shall be assured to all persons.
In the current controversy, complaint
comes from citizens who sav that freedom has been abridged by state or city
laws which require the readmg of the
Biole and the Lord's Prayer by school
pupils.
One of. the complainants has no rell·
gion, the other is a Unitarian and does
not accept all parts of the Bible
The Supreme Court's decision I h at
such religious practices do violate the
Constitution has the endorsement of
many, though far from all, religious organizatioons and leaders.
It should be noted also that the U.S.
rourt is not a pioneer in this field Sev-

government.

'
A slrlkiq diasent comes from Dean

Erwin N. Griswold of the Harvard Law
School AntictpatiJII the court's latest
ruling, and commenting on its 1982 derision In the celebrated New York case,
he says the court II construing the Con·
stimtion's language in far too rilid "absolutist" terms.
·
He argues that the founding fathers
meant to bar establishment of a stelesupported church, but not to expunge
from the nation's Ufe all sigilli and ceremonies of rellgloua nature.
Griswold contends further that anyone
who objects to school prayen, Bible
reading or other such practices can preterve his freedom simply by d~~Ciinlng
to tak• part. He says the penon who
does this must accept minority status
this places him in - and yet has a right
to expect the tolerance of othen.
The high court says In reply that even
when a law excuses those who do not
wiJh to participate, It is still coercive and
puts a stigma on the objectors.
In the cases just decided, it II o!so a
fact that tolerance by the majority wu
sadly breached. The complainant in Baltimore has seen her son abused physical·
ly many times, her home and car often
attacked, herself refused work. The Unl·
\arian in Pennsylvania has been subject
to violent, sometimes obscene written

abuse.
