MONTGOMERY, Ala.
Ousted Chief Justice Roy
Moore asked Alabama's
Stfpreme Court on Thursday
to return himi'o office. saying
his expu lsion sets a "danger·
ous precedent" and forces
judges to deny their oath of
office and religious faith.
Moore argued in legal .
briefs that he was removed
from office because he failed
a "religious te.st" in which he
had to choose between his
job and his allegiance to God.
The former chief iustice is
·appealing the Nov. 13 decision of the Alabama Court of
the Judiciary to remove him
for refusing a federal court
order to move a 5,300-pound
Ten Commandments monument from the roturida of the
Alabama Judicial Building.
· "I've been removed
'from public office - the
hi ghest judicial office in
this state - by an unelect·
ed, politically appointed
body, and they did not
question why I did not
obey an unlawful order of
the federal court," Moore
sai d at a news conference.
Moore 's appeal will be
decided by seven retired
judges who were chosen at .
random to form a stand-in
Supreme Court after , the
elected justices disqualitied
themselves from hearing the
former chief justice's case.
Attorney General Bill
Pryor, who prosecuted Moore
before the Court of the
Judiciary, has 20 days to file
a response to Moore's brief.
Suzanne
Webb,
a Former Alabama Chief Justice · Roy Moore listens to a
spokesman for Pryor, said he reporter's question during a news conferenc;e in Montgomery,
would need to stu()y the Ala. Moore and his attorneys were discussing the appeal of his
papers before making any
removal from office for refusing to remove his Ten

unethical," the brief argues.
· Moore, known as the "Ten
Commandments
judge,"
moved the granite monument
into the rotunda about six
months after taking offfce in
January 200 I, saying the
commandments are the moral
foundation of American law.
After a seven-day trial in
2002. T)ompson found the
monument to be an unconsll·
• tutional promo~ion of religion
by government.
Thompson's. order was
upheld by a federal appeals
court, and the U.S. Supreme
Court dec! ined to hear
Moore's appeal.
After the federal appeals
court upheld the order last
summer, Thompson gave
Moore 10 days to remove the
monument and the chief jus·
tice refused. The Judicial
Inquiry Commission then
suspended Moore from office
and brought ethics charges
against him before the Court
of the Judiciary. The monument was moved from the
rotunda into a storage room
by order of the eight associ·
ate Supreme Court justices as
more than 100 of Moore's
supporters protested outside
the court building .
In the brief filed Thursday,
MoQre said moving the monument would have forced
him to "forsake an acknowledgment of God."
'"Both the Alabama and the
federal constitution prohibit
Alabama from forcing public
officers to choose between
their job and their God," the
brief said.
·
At the news conference,
Moore said he is still seeking
a book deal and hopes to
have one soon. He said his
income at this point is solely
· from speaking fees.
Moore said hopes the book
will help people understand
what is meant by "the rule of
law" and "separation of
church and state."
"We are at a very critical
point in our country to determine whether the· federal
government· can tell us what
to think. A' lot of people seem
to be missing it," he said.

The day may be coming
when you will call your doctor in the middle of the night
with an ailment and he will
tell you, "Say two prayers

Doctors who believe in the
power of prayer are increasing.
The cover story in a recent
issue ot: ' Newsweek magazine carried the headline
"God and Health: · Is

Why Science is Starting to

In the Nov. 10 article,
Newsweek's Claudia Kalb
wrote that many of todaY:s
doctors are beginning to

The article continues,
"People who regularly

The Gazette, Cedar Rapids, Iowa, 011 America\ beef
supply:
America's beef supply shoulq be the world's safest, and.
ironically, it will be made safer because of the first U.S. case
of mad cow disease.
As cattle producers. meatpackers and the U.S. Department
of Agriclllture scramble to shore up consumer contidence at
home and abroad, the nation 's mad-cow testing program is
coming under the microscope, and rightfully so.
The startling news ... that a Holstein from a dairy farm near
Yakima, Wash., had bovine spongiform encephalopathy was
· only eclipsed by the fact that the fatal di sease was found by
fluke, and not because the animal was exhihiting symptoms of
a mad cow....
In the wake of the first U.S . case of mad cow disease,
stricter rules seem inevitable. It will .be expensive to expand
America's cattle-testing program, and consumers should prepare to he.lp bear the cost.

POMEROY
Minor
damage was incurred to the
handrailing on Pomeroy's
new riverfront walkway
when a loose barge struck it
Wednesday morning, accord·
ing to Mayor John Musser.
Musser said that the free
tloating barge hit a metal
shoot at the old coal tipple
causing a gapping .hole of I 0
to 12 inches wide, continued
down river and stuck the
unfinished handrailing across
from the telemarketing building . .
He said that the contractor
:will be testing the electrical
conduit in that area to be
sure everythin~ ·is in working
order. The Ohto Depanment
. of Transportation will supervise any correctiye work,
Musser said.

As you have · probably

Iraqi girls·· recelve corrective
heart surgery in Ohio
COLUMBUS (AP)
Ope.n-heart surgery , performed
on
.9-year-old
Waiveen Khalil has allowed
the Iraqi girl to get out of
her wheel chair far the first
time in two years.
Charitable donations from
Iraqi s
and · Americans
enabled a humanitarian
group to bring Warveen and
six-year-old Chra Rashid
from their hometown in
Northern Iraq to Columbus
for the surgery.
The Kurdish girls' congenital heart d.efects ' had kept
them from attending school.
'These two girls were
given the gift of life," said
Dr. Mark Galantowicz, codirector of the Children's
Hospital Heart Center. "It
involved hundreds of people
and hundreds of thousands
of dollars that were donated
·, graciously."
Medical treatment was
unavail;~ble for the girls in
their war-torn homeland.
"Because of all the years
of persecution, the (Iraqi)
health system has not
allowed places where these
girls live to ha,ve cardiac
units,... said Dr. Pary
Karadaghi, executive director of the Kurdish Human
Rights Watch. ·
Garden 'Valley, Texasbased . Mercy Ships, which
provides medical treatment
to people in· developing
countries, paid to fly the
girls and' 'their parents from
Baghdad to Columbus.
, On Wednesday, Warveen
walked into a hospital conference room on wol?bly
legs - after being in a
wheelchair for two. years.
· "Thank you so much to
everybody,"
Warveen's.
father, Tahseen Khalil. said
through an interpreter at the
news conference.
Warvee n's congenital heart
disease had prevented sufficient blood from getting to
her lungs and enough oxyge n to her body. She
became exhausted easily..
A I 0-hour surgery performed two weeks. ago core
rected the problem.
Chra underwent surgery to
close a hole between two
lower chambers of her heart,
while a small vessel was
opened wider and an
obstruction was removed.
"Every time I looked at
her, she had purple lips.
Now she has red lips," said
her father, Sarbast Rashid.
