Sterling, assistant to lhe chief of the division.
Ohio Valley extracts the coal through a
process called long~wall mining. The coal seam

Sterling said. In addition, the divi sion will limit
the amount of coal removed from the area:

The division's decision also prohibits the
company from reroovi~g coal from three other
coal seams in 1he area, and bans strip-mining
entirely in a 605-acre area.that includes the oldgrowth forest and a buffer zone around it.
The university had asked the division to
.declare the area and a buffer zone extending
about 1,500 feet unsuitable for mining.
Gary North, the university's vice president
for adminstration, said he .and oth er officials
were analyzing the decision and have not yet
determine~ whether th e division ,built in
enough protections.
·
·
Ohio Valley President Robert Murray did not

·return a phone call seeking comment today.
Chad Kister, an environmental activist i,n
Athens; accused the division of caving in to
pressure from the coal industry.
•
"I think it 's entirely political," said Kister,
who he&ds the group Dysart Defenders.
Kister maintained that a 4,170-acre protected
area was needed to save the trees from damage
from water pollution ca used by mining, and
that no mining should be allowed under the old·
growth area itself.
Murray, who estimated the coal's value at ·
$3.3 billion, had threatened to sue if the mining
was blocked.

may bring jobs to Ohio
There's a new blue and while Oag flying over the Jeep assembly compte•
in Toledo. ·'
It's the only noticeable change since new parent company Daimler·
Chrysler· began operating last week. But regional growth directorw say the
automaker eventually could bring new businesses to the area while also
making jobs at Jeep more secure.
The merger between Chrysler and Germany's Daimler-Benz AG created
the world's fifth biggest automaker.,. .
The deal i1 important 1o the Toledo area where there arc about 7,000
-~ ~ DaimlcrChryslcr workers, easily making the company the region's largest
employer with an annual ' payroll of about $400 million.
Already several German auto parts companies have shown inleresl in
moving to nonhwest Ohio and southeast Michigan where labor costs are
lower.
.
".We're talking to new suppliers who have never been here before," said
Lee Springer, director of international business development for Toledo 's
Regional Growth Partnership.
.
. And there is hope that eventually the new company will help Jeep sales
overseas.
David Cole, diiector'Of the University of Michigan's Office for the Study
of Automotive Transportation, said Jeep should reap the rewards of teaming
up with Daimler's m05t successful product- Mercedes-Benz.
"Jeep will be able to piggyback on the global distribution methods of
Mercedes," he said. "It will lake awhile, but it can't hurt." ,
Thai's key in an industry now reaching across traditional boundaries into
a global marketplace. New statistics show foreign automakers today produce
one of every three cars made in the United States aQd handle about two·
thirds of all U.S. car exports.
DaimlerChrysler already has begun an ad campaign that will appear in
more· than 100 countries. But it plans to advertise its vehicle brands scpa·
rifely.
: Jeep already is sold worldwide, so the company won't be looking for new
nfjlrkets. "Jeep is one of the m05t recognized names around the world," said

At this writing it.eerm alm05l certain that the
House Judiciary Committee, about mid-Decembcr, will vote along straight
party lines 1o repor1 out one or
more anicles of impeachment
against President Clinton. One
anicle is vinually inevitable:
that Mr. Clinton committed
perjury •• i.e., lied under oath • repeatedly in his deposition
in the Paula Jones case, and
again (once more, repeatedly)
in his testimony before the
Washington grand jury.
Practically the only people who still deny this
are Mr. Clinton and his lawye,;, who don't dare
admit 1o perjury because they are well aware that
this would make an open-and-shut case foi his
indictment and prosecution t~e day after he steps
down as president in January 2001.
(WhetHer a District of Col urnbiaorArkansasjurywouldconvict
him, as the recent case of O.J.

maneuver ro1 a slap on the wrist.
(And it would be justa slap on tbe wrist Congress censured President Andrew Jackson for his
actions in a furious banking controversy, but a
later Democratic Cohgress e•punged the censure
•• and a still later one put his picture on the $20
bill.)
·
But has anybody seen a poll in which people
were required lo distinguish clearly between
impeachment by the ·House and removal by the
Senate, and then 85ked whether they would
oppoK impeachment if it wercn 'I followed by
removal? 1 haven'~ because (I suspect) there
aren 't any. The pollsterJ have been busy helping
the Democrats obscure the distinction between
the two steps, counting on the public's confuSion
1o spar~ Mr. Clinton the devastating impact of
being impeached but not removed.
·
For that would be the beauty of a resolution IJy
the whole House to impeach the president. It is
the only action open 1o the House that is unques-

.

.

But lhe ques11011 .0f whether to remove hu!l
from office r,ould then go to lhe Senate, ~here II
is flear that there is no chance of amassmg ~e
ne<lessary two-thirds vote to do so. ,The pubhc
would then gel what il apparently wants: Mr.
Clinton's retention in offi~ ·• notaf~r ~e slap
on the wri5t, but after a h1slol)'-makmg 1mpeach·
rnenl by the House.
The great majority of House Repu~licans will
favor this. All but a few Democrats wdl oppose II
and try lo substitute some meaninaJess con~natory reso)ulion. A number of the usual Repu~h·
can wimps are said to be ready lo go, along w1th
them ·· perhaps enough to carry lhe day, barely.
The vote of the members of the House~ the
impeachment resolution, in t~ Ieeth of Pres1dent
<;linton's manifest crimes, w1ll.~ one t_hat they
had better be prepared to cxplam to their fellow
Americans until their dying days.

that the plaintiff, Kathy Monteiro •• in regard to
students' racial harassment of .other students ·· ,
has' a valid claim under Title VI of the Civil.
Rights Act of 1964, which reads:
.
"No person in the United States shall, on the
ground of race, color or national origin ... be sub·
ject to discrimination under 'any program or activ·
ity receiving federal financial assistance."
Although the court found no factual basis for
the claim that the book caused tile racial taunting,
it decided ihat the failure of the school district to
deal with thi s "egregious" racial harassment was
a clear violation of Title VI.
"It goes without saying," Judge Reinhardt
declared, "that being called a 'nigger' by your
white peers (or hearing that term applied to your
black classmates) exposes black children to a
'risk of discrimination' that is so substantial and .
obvious that a failure to act can only be the result ·
of deliberate indifference."
' As for exiling Mark TWain because of his use .
of the word, Reinhardt pointed out that "Many
school di stricts, would undoubtedly prefer ... 1o
substitute 'safe' (books) to reduce the possibility
of civil liability and the expensive and time-con·

"When you can improve your

"Ji 's amazing," Benes said. " I've

Judge halts airport

'CHARLESTON, W.Va. (AP) State government proponents of a
regional airport in the Charleston·H~t·

barring the Publ~c Port Authority from
selecting a new stte for a regtonai rurport
for at least 30 days.
.
Rod Blackstone, a spokesman for
' Gov. Cecil Underwood, said the delay is
_frustrating
because
Underwood

The JlfOC""' could be "our last best
hope to develop such a project and reap
the eronomic and air service benefits
that it might hold," Blackstone said. ·
Kanawha County Circuit Judge Tod
Kaufman on Tuesday issued a temporary injunction preventing -'the . port
authority from choosing a site for the
new airport at its meeting today, as tt had .
been expected to do.
•
Independent consultants hired by the
authority have recommended bu1lding
the airport at Evergr<en Church, Putnam
Cbunty, in part because of its_ proximity
to both CharlC5ton and Hun~ngton and
because of its relatively flat landscape. A
site in Lincoln County known as the
lntellitale 64 site also is a front·runner.
Yeager Airport officials in
ChariC5ton sought the injunction, saying
state law requires its appr<;wal before.th~

CHARLESTON, W.Va. -A West
Virginia House of Delegates member
representing Mason County has started
a campaign to name the proposed, bridge replacement connecting M'!-5on
and Pomeroy in honor of veterans.
In a letter to West. Virginia Gov. Cecil
H. Unde~ood, Delegate Jerry K. Kelley has requested 'the bridge be named
"Veterans Memorial Bridge."
"The Bend Area of Mason County is
very patriotic and · has many veterans,
both living and who have passed from
this life. This would be a great tribute to
the memory of these veterans and the
Mason County citizenry at large," smd
KeiiH, a member of the legislature's
Veterans' Affairs Committee.
The bridge is now owned by the
state of Ohio, but once a replacement is
built, will be owned_by West Virginia.
